If you are dissatisfied with the actions of a bailiff, you have the right to file a complaint against the bailiff’s decision or actions in enforcing an enforcement instrument, or against the refusal to carry out an enforcement measure. The complaint must be submitted in writing and may be made in free form. However, it must contain the following information:<\/p>\n

    \n
  1. a) The identity of the person submitting the complaint;<\/li>\n
  2. b) The enforcement case concerned (case number and details of the debtor or claimant);<\/li>\n
  3. c) The enforcement measure against which the complaint is being filed;<\/li>\n
  4. d) The grounds for the complaint, specifying what is being alleged against the bailiff in connection with carrying out the enforcement measure or refusing to do so;<\/li>\n
  5. e) The remedy or outcome requested in the complaint.<\/li>\n<\/ol>\n

    The complaint must be submitted within ten days from the date on which the complainant became aware, or should have become aware, of the decision or action, unless otherwise provided by law.<\/p>\n

    The bailiff shall review the complaint with the participation of the parties to the enforcement proceedings within 15 days. Within 10 days from the review, the bailiff shall issue a reasoned decision and serve it on the parties to the proceedings.<\/p>\n

    If a party to the enforcement proceedings is dissatisfied with the bailiff’s decision on the complaint, they have the right to appeal against that decision to the county court (maakohus) within whose jurisdiction the bailiff’s office is located. The appeal must be filed within ten days from the date on which the decision was served.<\/p>\n

    For example, if you wish to file a complaint concerning the actions of a bailiff in Rakvere, you must submit your application to the Rakvere Courthouse of Viru County Court.<\/p>\n

    It is not possible to appeal directly to the court against a bailiff’s decision or actions without first submitting a complaint to the bailiff.<\/p>\n

    When filing a complaint with the court, including through the e-File system (e-Toimik), a state fee of EUR 15 must be paid.<\/p>\n
